I do not understand how so many lawyers and judges get through law school without reading AND understanding the Constitution.
I just went back and reread the Bill of RIghts. The 1st Amendment is the ONLY one that specifically states that "Congress will make no law" the remaining amendments speak to all of America - Congress, the legislature, the Executive and ALL levels of government and the people. It is clear and simple language - there is NO reason for a a retired Supreme Court justice to think differently unless he/she is senile.
